Tips for Finding Ontario Costs Assessment Decisions

We are often asked how to find assessment decisions – both decisions involving the assessment of costs under Rule 58 of the Ontario Rules of Civil Procedure, and decisions involving the assessment of a lawyer’s account under the Solicitors Act, RSO 1990, c. S.15.

There is no specific reporter or source for assessment decisions that we know of. So we’ve tried various search strategies in general case law sources. Here’s the search that works best:

In Lexis Advance Quicklaw, follow these steps:

  1. Select Court Decisions from the Explore Content box on the Home Page
  2. Select Ontario from Jurisdictions
  3. Then click the Advanced Search option (found on the right, above the big search bar)
  4. Type “assessment” into the Judge field, which will pull up the cases with “Assessment Officer” in that the field.

N.B. Typing the phrase “solicitors act” in the Terms box in the Advanced Search template will limit your search to Assessment Officer decisions resolving lawyer/client disputes about legal bills.
